    Can an alleged father obtain custody after 13 years
    The alleged father and wife renege on the agreement of letting my son visit them until paternity test would be established. They decided to use Parent Alienation Syndrome tactics against me. I had to have the police intervene and returned my son to me. However, the alleged father refused to return my son's belongings. He told the officer that he was going to use it against me in court. He put restrainer order on me and my family. On court day the alleged father never showed up. The alleged father had never known that my son might be his because he told me that he could not have kids. However, after 13 years the alleged father wants custody. He filed for custody against me. I would like to know could he get custody. Even though, a false allegation was placed against me 2 years ago and my son was in temporary custody and returned to me shortly. How would that affect my custody case. The alleged father and his wife has threaten to beat me up and I have them on my answer machine. Also, I would like to present all my every evidence against them. Do you know what California forms would I use to submit my evidences. Thank you:confused:

    Get an attorney. I'm sure the other side will have an attorney and you will be at a distinct disadvantage if they do.

    It sounds like they will have a hard time getting custody, but if they have an attorney and you don't, you are making it easier for them.

    I agree with Scott - because of the background and history (for example, I don't know why you allowed a man who is not the proven father to take the child for a visit - this man is a stranger to your child and if he's not the father I can only imagine how the child will feel) - you MUST have an Attorney.

    And you need to get the paternity issue settled before you worry about custody.
