    Warrant for not making car payments
    In the state of Georgia can they put a warrant out for not making your car payment and how long do they need to wait if they can. How months

    They can come and take your car pretty much anytime after the payment is late.
    I have seen cars repo-ed three weeks after the late due date.
    I have never seen or heard of anybody being arrested for non payment.

    Defaulting on debt is a civil not a criminal issue. Debtors prison went out in the 19th century. Therefore they cannot obtain a warrant for your arrest over nonpayment of a debt.

    If you default on a debt, it depends on whether the debt is secured or not as to what they can do. Options are repossessing the asset (if secured by the loan) or filing a judgment for the balance of the debt.

    Also when I worked with a repo guy he told everybody that they had 30 days to come up with the late payment plus the fees and charges and they would get their car back. Don't know if that would help in your situation or not.

    As Scott said, this is not a criminal matter UNLESS you are precluded from leaving the State, you've attempted to transferred title, there is some other type of fraud involved, not just a matter of not making car payments.

    Not making your payments isn't a crime. Lying on a loan application to get the loan, and then not paying IS a crime.

    Well guys thanks for your comments but I keep hearing that they can put a warrant out for your arrest if you fall behind in your car payment in Georgia. Even thought I starting paying them back for my late payment plus. They say because the car is not fully mine it is consider stolen property if payments or not made but I just can't seem to find that in the law book. Are these people for real or are they be sing me

    Who is telling you this? The lender? Of course they are going to tell you this to get you to pay. If they tell you this again, ask them to cite the state code statute that allows this. They will shut up quick.

    Next time they tell you that, reply to them that you are taping them, and that THEY are committing a crime by saying that, and you're going to PUT THEM IN JAIL.

    Good Advise. What they are doing is ILLEGAL! You can't go to jail for not paying your car payment, period.
