    2 Separate issues with NJ Taxes
    Hi
    I have 2 separate issues with filing NJ taxes for 2004 and 2005. I am non resident of NY and resident of NJ. My W2 shows NY Tax withheld and no NJ tax withheld for both years.

    1) For 2004, my CPA never mailed the returns to NJ and NY :(
    Now I prepared the returns using TaxAct and have everything ready.
    My question is, do I need to send a copy of W2 with each form? Also, if I am supposed to get a refund from NY and no taxes owed to NJ, will I be fined for late filing?


    2) For 2005, I used TurboTax. It is a very nice tool. However, since I was filing for the first time on my own, I made a mistake and did not report my W2 wages for NJ return!! Later, I figured out my mistake and corrected everything. I now have my NJ1040X ready for mailing.
    My question is, along with NJ1040X do I need to attach a copy of W2?
    What about a corrected NJ1040?
    I also have a 1099Misc that I correctly reported to NJ when I e-Filed the first time. So do I need to attach a copy of 1099 along with the same? Specially since it has a different (non NJ) address on it. Is it necessary to mail the tax owed with the NJ1040X or I can pay separately via CC?

    1) Yes, attach W-2s to each state tax return and to the federal return as well. No, if you owe NO taxes, then there should be no fine for filing late!

    2) Attach the corrected NJ1040 to the NJ1040X. If you sent the W-2 with the original filing, you do not need to attach a W-2 to the NJ1040X. You do not attach Form 1099-MISC unless taxes were withheld and that withholding is shown on the Form 1099. You normally need to send the check with the Form NJ1040X, but paying with a credit card is becoming an increasingly popular choice. You need to call the NJ DOR to find out if paying with a CC is an option.

    Thanks for your reply.

    1) For 2004, I did file Federal Taxes and got my refund too. I only have to worry about the 2 states.

    2) For 2005, I originally filed Electronically. So do I need to send the W2?
    Original or Copy?

    2) The W-2s are not needed. They got a copy of all W-2s electronically, along with the tax returns.

    Forgive me but for 2004 Tax returns, do I need to attach original or a copy? I checked the NJ 1040 form and it doesn't say a copy or original. This is the only question that is still bugging me.

    Copies are fine. All the NJ DOR wants is the INFORMATION.
