    Can he take my kids
    If my husband does not have a job, can he take my kids when I divorce him?

    One hopes custody is awarded with the kids' best interests in mind... If so, who can provide a better standard of living for the kids? May God bless you...

    Unless there are circumstances that could be potentially harmful... young children most often stay in the environment they are most used to. If mother is the primary caregiver now, majority of the time it will remain that way. In some cases, older children, depending on their age, can have some say so in where they live.

    If he can not prove that he has a good environment and financially able to care for them whereas you can then legally no he would not be given any more than joint custody with visitations.
