    Tenant/landlord law involving drugs?
    I rent the rooms of my home out. There is one man living there that I need to have gone. He uses drugs, pot and cocaine. I live there with my 5 year old son and am scared to be in my own home because of this man! I run the risk of having my son taken from me for the actions of this man! What are my rights and how can I get this man out legally?

    You have to evict him and follow the laws of your State BUT if he's dangerous and you are afraid you attempt to get a restraining order. Sometimes the Judge will issue the Order AND the eviction order at the same time. Other times (and I know this makes no sense) they'll issue the restraining order but not an eviction so I don't know what anybody is supposed to do.

    Have you just asked him to move?

    If you are concerned you can always ask the Police - maybe they'll hassle him but I doubt it. I am aware of a similar problem in which an elderly widow rented a room to a guy who was a big time dealer - her family went to the Police and expressed their fears and the Police showed up and told him to pack and go. He argued that he had rights and the Police explained they had the right to charge and hold him and away he went. Highly illegal but the Police really were great about things and kept the elderly woman safe.

    Talk to law enforcement. Do not allow circumstances to intimidate you... predatory people use that against their victims... think of your sons' future if continued in that environment. May God bless you.

    Is there drugs in the home, call the police and turn him in,
    Get a restraining order and have him removed form the house.
    Or evict using standard eviction methods.
