Is doctor in the wrong
I'm not sure what to do? My 11 year old daughter had a fever and said that her private area hurt. So I took her to the urgent care, they took some test than told me she had herpes. Gave her a persciption of valtrex told us we need to take her to her regular doctor. So we called her doctor and he don't deal with that area, so we called my ex wife's (my daughter mom) OBGYN to get her in there and they wanted to get the test resaults back first. They got the resaults back and everything came back negative and explained what it was. Some kind of viral infection. She said it happens to a lot of young girls and it was not herpes. A couple days later the urgent care called and wanted me to come in for the test resaults. So we did and he told us it was negative on all the test they took. He had the papers in his hand. Then he said he still thinks that she has herpes and wanted to do more tests. I told him no the OBGYN will she her instead. He than told me he was going to call CPS even thought the tests were negative. So now I have CPS calling me at work,calling my ex wife,my day care to talk to her, came by daycare and pulled her to the side and talked to her. All because of what this doctor FELT. This doctor has caused all kind of embarressment for me and my daughter. He had me stressed out thinking my child has been assaulted all because he THINKS that is what she has. It seems to me and others that I should be able to sue him or something. Does anyone know what I can do. It is still going on as of today. Thanks

Young girls can get viral infections just from their underpants being too tight, detergent residue, water used, whatever.
I would call, what we refer to here in Canada as the College of Physicians and Surgeons, I don't know what you call it there. They will take your complaint and advice what to do next, if anything, but I do realize you are upset and from what you state, this doctor is way out of line.

Hopefully she is fine, Sounds like you are in South Florida? I have seen groups of Doctors Pass around patients, and each would be able to make a little money?
What ever happened to the Hippocratic Oath?
The first doctor "Sounds" like another piece of Crap needing to generate money for his style of living that he has been accustomed to. Good Doctors are Great, hate the Incopetence.
Provide a copy of the Results to CPS.
If he should provide a copy to CPS and he is wrong, it will help your case.
Good luck, not a doctor or lawyer, seen many bad doctors, and lawyers.

There are places to report the Doctor's questionable behavior but the only way to stop this dead in its tracks is to hire an Attorney - unfortunately.
I don't think reporting him is going to stop the phone calls and anything that may follow.
I trust you have something in writing from Doctor #2 on the offchance that this will be taken very seriously you may have to respond quickly - ?

In the situation your in I would be looking to sue because the doctor at the hospital is not a specialist but a general practitioner and an obgyn is a specialist in this area. You in no way neglected your daughter and followed up as best as you could including letting your ex know what was going on. If anything this is a case of system failure because the doctor could have made a call to your obgyn and confirmed ongoing treatment.

You have got to appease the child protective people for them to stop calling you and your ex. You need to bring them the testing results and maybe a note from the OBGYN dr how your daughter is being treated and the negative results for herpes. CPS tends to go overboard on anything these days and your scenerio is no exception. Try meeting with them in their office and calmly show them the paperwork. As far as dr #1 is concerned, he apparently likes to turn in parents and kids to the CPS. Maybe he gets a kickback from them, who knows? In any case, any dealings with CPS must be done very calmly and deliberately even if they insist they put you through hoops to appease them. Whatever you do, don't argue with them or yell, etc. as they can be ruthless and very vindictive in any retaliation they can throw at you.

You first and real problem is not what the doctor did but the CPS, they can even come and take your child away and make you prove it is OK latter. Hire an attorney RIGHT NOW to deal with them.

Exactly my point - I would worry less about reporting the Doctor for an alleged malpractice and more about safeguarding the child's rights - including having ON HAND a medical report from Doctor #2.
