Legal way to set up a Mobile home
Is it legal to loan money on a single wide mobile home that is set up like a house? It has been put on a deed just like a house. There is no title to this mobile home.

As a private party, I believe it is legal to loan money for any reason for a legal purpose. Of course you cannot loan money for the purpose of doing something against the law, but you can loan money without collateral if you want to take the risk. The problem you may have with the mobile home is; without a title, how do you show proof of ownership ? Of course you cannot foreclose or repossess property that you have no rights to.

Are you loaning or trying to borrow money on just the mobile home ? Or on the home and the land. If the loan documents are set up to show the land and the home it should be OK. Many loan companies will not loan money on older mobile homes.
Also if this is a mobile home, it should have had a title at some point, which could end up being a legal issue at some point if someone is holding that title. So be sure if you are buying the mobile home be sure and get paper work saying the seller is the owner of the mobile home and is sellling you all rights to it, and will pay to defend that ownership.

The title to the home should have been surrendered to the county when it was put onto the deed and incorporated into the real property. Contact the recorder's office or county auditor's office to see if the title has been included in the deed of the property. Otherwise, the home still has a title. If the recorder's office verifies the title was surrendered, then the real estate is the collateral for any loan. This would include both the home and the land just like it would be if it was a stick built or site built home on the real estate. The home and property would be taxed as real property together and not the home separately and the land separately. I take mobile home titles regularly to the county auditor's office to be surrendered to the county and the home made into real estate. This is generally done with brand new manufactured homes as a rule but it can be done with manufactured homes of any age so long as it's acceptable to the county auditor's office. In some counties in Ohio for instance, they will not "marry" the manufactured home in with the property unless the home is a minimum of 1,200 sq. ft.

Just curious: how do you know there is no title to the mobile home?

My sister has a leaky garden tub faucet. We can't determine how to access under the faucet. There is no access door. A closet is behind the faucet. When we remove the wallboard, we find the distance from the opening to the faucet too far away to access. Can you help?
