    Single Mom Needs To be able to sleep again
    My friend who was also my landlord.I rented her home there was never a formal lease just a written agreement on a piece of writing paper that I was to pay 700 a month.My work slowed down I became broke she told me sign overmy income tax refund for what I owed.I was going to well I did not get much back because of an error.She then after I moved out (I was not evicted either)I moved out because I could not pay.So now she is taking me to court Am I going to loose my shirt.I mean I am a single mom I get no child support and don't have a lot of money.

    Welcome to AMHD. Many courts will recommend a consent judgment to resolve the litigation. If you and your landlord agree as to the damages (and you may not agree with what is being demanded), the judge may allow you to make monthly installments. In the meantime, if the landlord knows where you bank or work, you may be garnished. You can change banks easily enough; it can be more of a problem to change jobs.

    Well, she can't collect more than you owe her for starters - but if you lived there, you owe her rent.

    This could very well be an instance in which the landlord can get a Judgment which she cannot collect. In some States you qualify as head of household so your wages cannot be attached.

    Just go to Court, take your proof - so she doesn't get awarded more than you owe. I don't see a defense here (unfortunately). Not having the money to pay is not a legal excuse not to pay.
