    Do we have rights
    Our landlord said we they never received our June payment... said they served us but we never received a notice... sheriff said he served us... never saw it... do we have to get out or are we messed up?

    Unless you can come up with a June receipt or come up with money to pay for June
    Since the Sheriff is involved sounds like you have to get out when they say.

    Hello amanda:

    In most states if you cure the rental defect BEFORE your landlord get's the actual eviction in court, you should be able to stay.

    Not all state laws are the same, however.

    How did you make your payment? Check, money order, what? How did the sheriff say you were served? What proof do they have of service?

    There are a lot of gaps in your story that need to be filled in.
