    Bankruptcy 13 left of stay for Foreclosure
    My mortgage company starting foreclosure proceedings and I filed Bankruptcy 13, however it was dismissed, what happens to the foreclosure proceedings, do they continue where it was stop at time of Bankruptcy?

    Yes. Once the BK was dismissed, all the creditors are open to continue to collect the debts.

    The only thing different now, is you probably owe more than when you first filed the BK.

    What happens on foreclure when Brankruptcy is dismissed?
    In October of 2007 I contacted an Attorney to file Bankruptcy, since I was in debt. She advise me not to make any payments to any of creditors and/or mortgage. My Attorney informed me that payment arrangements would be handled through the Bankruptcy. Unfortunally
    My Attorney waited about 6 months to file Bankruptcy Chapter 13. In May 2008 I received a letter (notice) regarding my Mortgage in default and foreclosure proceedings will began and to have my attorney call Mortgage Trustee. My attorney filed Bankruptcy shortly thereafter. Bankruptcy court dismissed it because I could not afford payment plan.

    I don't know what to do next can you help me plese!!

    What can I do to fix this?

    Not knowing all of your debts , file bankrutpcy chapter 7 on all debts of property you are not going to keep, ( first of course see if you can make payments on things you want to keep) talk with the mortgage company and see if you can arrange a payment plan to start making current payments and work out the back payments over time

    Or file a chapter 7 on everything and walk away and start over.
