    Violated Stipulation of Agreement?
    NY State - Signed our Stipulation of Agreement in April 2008. In it, my ex-spouse had 45 days to give me a payout from one of his life insurance policies. He was also required to get a Life Insurance Policy in the amount of $100,000 and make me the irrevocable beneficiary to cover the costs of college in case something happens to him. I already have one set up since last year. Also, there is a bank account set up for my daughter in his name stemming from a lawsuit we both were plaintiffs in. He agreed to send me monthly statements and I haven't rec'd anything. The only thing he has done is pay the child support (always one day late).

    What is my next course of action. I tried to call him and left a message but he hasn't got back to me as yet. Now in the stipulation it states that if anyone of us fails to adhere to the agreement and the other person has to take that person back to court they are responsible for all courts cost, attorney fees, etc. Not sure what to do as he has owed me money and promised to pay me back and never does. How do I get him to pay the court costs and attorney fees? He just thinks the legal system is a joke and he can do whatever he wants and so far he has been able to. There were times when we had to appear in court he won't show up but no one notice as we didn't see the judge at all and the attorneys saw his clerk. Meanwhile, I had to take time off from work.

    I tried calling my attorney but haven't head back from them either. I'm at a lost as to what my step is. I want to get on with my life and he is making it difficult for me. This is a divorce I DID NOT WANT - he did. I gave it to him with no fight and now all I'm doing is fighting for what he promised. HELP!

    Your next step is take him back before the Judge who divorced you and let him explain to the judge why he has not done any of the above things you mentioned. Keep after the attorney on this as he can collect all the attorney's fees and court costs from the ex as stated in the paperwork he signed so it's essentially a free ride (legally) for you at this point. Call your attorney's office and make an appointment and go see the guy.
