    Is it legal to apply for H4 stamping if the H1b is already approved
    Hi,

    I'm presently in USA on H1b and my wife is in India, her H1b got selected in the lottery for April-2008,and it approval on 3-june-2008.
    I wanted to bring her here on June-2008, so planning to apply for H4 visa also.

    Would like to know , whether is it legal to apply for H4 stamping if the H1b is already approved. Is it valid ?

    You can't apply for H-4 when you are already approved on H-1.
