    Summons not served w/in 120 day limit. What is next?
    Summons for old credit card debt. Process server unable to serve me w/in FL's 120 day limit. Does anyone know what the next step for the law firm that is from the opposite end of the state? I intend to defend and request validation but will not make it easy for them. Any answers appreciated.

    If you were not served the appropriate time frame more than likely the law firm will just refile and try to serve you again. Expect it to be refiled within a month or so or whenever the paperwork is cranked out again and taken to the courthouse to file.

    If it were me, I would file it until I got you served, one way or the other, but that's me.

    Actually, who knows?

    The amount of money they are seeking would have a big impact upon how determined they may be, that along with how confident they are in being able to actually collect the jugdment should they receive it.
