    You get injured on the job and your employer requires a drug test if there is an injury, you have basically already consented to take the test when you accepted employment.

    Hello suit:

    You probably gave them consent to treat you. If they need to know what drugs you took in order to treat you, then they can because you said they could.

    However, if they took the drug screen and turned it over to the cops, then it's not legal at all. If they're trying to prosecute you, plead not guilty.

    If you present as a trauma pt. driver involved in a auto crash or with altered mental status, YES.

    Any agreement you have with your employer is separate and apart from the relationship and privilege between doctor and patient. Your doctor has a responsibility to YOU and your well being. Any testing done at the hospital could not be turned over to your employer without your consent.
