Ex-Husband is $50,000.00 behind on child support
My ex-husband who lives in Georgia, I live in Kentucky, is $50,000.00 behind on child support and medical payments in two and a half years. I have filed all the paper work with the child support office, and have even had a non-flagrant child support warrant issued by the Grand Jury. Because he is not in this state, the only way to pick him up is if he gets pulled over and they run his name. He doesn't even have a valid drivers license. We were married for 14 years, have three boys, and I finally got out of all the hell of drugs, lies, and scandals in 2006. He always gets a job where they pay him "under the table" so that I can not get his checked garnished. When he filed his 2006 tax return, he listed myself (I remarried in October 06), and all three of the boys as Married Filing Joint (remember, we were divorced in Feb 06), he forged my signature, along with everything else on the paper, and received almost $5000.00 from the IRS. I have contacted the IRS, and they still to this day, have done nothing! But since he used the boys (which in the divorce papers states that only I can claim them on tax papers), we (myself and my husband) have had our returns messed up for the last two years. We have had to send them medical records, school records, ss cards, birth certificates, etc.. To prove that they are mine and with me. The IRS is now saying they will investigate the matter. What in the world can I get done to collect my child support, and get all of this straight with the IRS? Why don't the police and the IRS get him?

Somehow I think its going to take more information on your part to get a good answer. $50,000 in 2 1/2 years is pretty steep for child support when your saying he works under the table. It works out to about $1,600 per month. Another thing is it sounds like someone isn't doing their job correctly. Which state holds jurisdiction for the child support ?

Maybe you can have it transferred? That way the " local " authorities can take care of the matter. Also if he is in jail your not really going to be receiving anything so maybe you need to evaluate how your going about things. What does the original paperwork say ?

First I couldn't agree more with calif. How was the support figured if all his jobs are under the table. Also, the IRS has a LOT on their plate to rush off and start an investigation over $5,000 which is why they will get to everything but it takes time. As noted if he is in jail he can't work to pay support so the debt will be evev larger. There are a few agencies such as support kids that will help collect (each one works off a different percentage) you might want to look one of them up and see if you can get a case with them.

Before we got a divorce, he was a mechanical engineer with the Union. He made 72,000.00/year. He is suppose to pay 320.00/weekly, and is suppose to pay for medical insurance. If medical insurance is not paid, he is responsible for the medical bills. Three children adds up with medical bills. He quit the union when I left him, and said I would never be able to get anything out of him that he didn't want me to get! The boys do not trust him at all. He continually lies to them, telling them he is coming to get them and never shows up. He has a severe drug abuse problem, and will not seek help. Two of his brothers are in jail for drugs. And by the way, this is not the typical low life, poor, skanky, drug family. They are worth a fortune, and have decided to turn to the life of crime and drugs. I got sick of it and left! The boys did not need to grow up thinking that because your last name is "so and so", you can act and do anything you want to. They are glad to be out and see what a normal family is like. Thank you for your responses, and if you know anything else, please let me know!

If you know where he lives, have you contacted the local police there or the DA.

Yes, Fr_Chuck. They tell me unless he is pulled over and his license are run through the system, that is the only way to get him. This small town that he lives in, is corrupt, and everybody knows them. Their name alone, keeps the police from bothering them. I can set him up to come get the kids, and the police here in my town will get him, but he's not that stupid. He isn't going to come here. The police here told me that it (the warrant)is in a national system, and when he is stopped, or applies for a gov't job, whoever will take him into custody, and KY will come pick him up. I don't know... I'm beginning to think the police are always for the guilty ones. The IRS won't leave us alone, and the police won't pick up a person on a felony warrant?? Go figure!!

What you really need to to is have the case transferred so it becaomes a local case and they can pick him up on the warrant and not just expect the police from your district to drive down and get him. The police have rules and must follow them or they will be in trouble. If he's drug addicted etc then he most likely isn't working to his full capacity as most places require a drug test before you can start working there. Ask your local agency what its going to take to transfer it near him.

Just had a thought - does he live off a trust or inheritance?
