    Changing name on house title after divorce
    My wife got the house in her divorce settlement. How does she change the title to her name only. It is still in both her and her ex-husband's name.

    The mortgage company refused to allow me to remove my husband's name without refinancing (and removing him from the mortgage) so it remained in both names. If he had protested I probably would have had to refinance.

    I kept my ex informed by furnishing him with proof of insurance so he had no liability, proof of payment of taxes, he carried it as an asset on his credit application (even though he no longer had an interest) but he could have pushed the issue had he chosen to do so. The payments were always timely but if I had been late it would have adversely affected him so he was a good guy about it.

    You can't - your wife would have to ask him to sign a deed, quick claim or otherwise. If he refuses then she would have to go back to Court with her Order and ask that it be enforced.

    You have no legal position in this.
