Filed 1040 for years 2004-2007 using Taxslayer
    Hi,
I am an international student from India, here on F1 visa.
I have unknowingly filed my taxes for the years 2004-2007 using 1040 instead of 1040nr. The mistake happened because I was led to use the online tools such as taxslayer.com

I am worried now, since as an international student I should not be getting the economic stimulus checks... but due to the error in my tax files, I will probably end up getting it. It all seems very dubious... I am going to H&R to correct the error immediately... but can someone tell me if the IRS will take an extreme action if they realize this mistake.

    Thanks.

Okay, first, do NOT spend the stimulus check if you get it, because, as you know, you are NOT eligible to get the check.

When you amend the returns, you should then send the stimulus check BACK with your 2007 amended return.

As for going to H&R Block, get a quote as what they will charge you for each of the four amended returns, then PM or email me at the email address below for our quote.

I suspect you may find our quote to be somewhat better.

    Thanks for the prompt reply.

I was working on the form 1040 NR. Do you know for sure if being an Indian national I can just apply standard deduction instead of the itemized.. in which case my refund will be the same as 1040.

Yes, as per tax treaty between the U.S. and India, students from India get standard deduction.
Read Your U.S. Tax Return: U.S. Tax Treaties for Students and Apprentices

If you are amending your tax return, you will file Form 1040X, properly done nonresident tax return (rite amended return on the top) and Form 8843 for each year.
