Statute of limitation in Ontario on injury claim
In April of 2007 in Ontario Canada, where she resided, my elderly mother fell as a result of a coat rack on wheels not being secured in a church. She broke her hip, which was repaired but prevented her from continuing to live with my sister. As a consequence, she was placed in a private seniors nursing home where she subsequently died in September 2007.
I feel there is a lawsuit here which would allow us to recover the added costs incurred from the time of the accident until she passed away. Is there a statute of limitation on filing such a lawsuit and if so would someone please inform me what it is. Also any comments on the viability of such a suit would be appreciated. I live in the USA and am not familiar with Canadian/Ontario law.

The limitation period in Ontario is two years from the date the cause of action arose (or when it was discovered). Certain conditions apply.

Given the nature of the potential claim that you have described we recommend you consult with an Ontario-based lawyer (which we are not). The accompanying web address will help you in this regard Lawyer Referral Service
