    Child custody
    Hello:

    I am a California resident and going through a very challenging divorce. Among other issues, my husband and I disagree on child custody of our son (12) and daughter (9). He was diagnosed with mental illness and has been abusive to me and the children. He underwent a psychological evaluation ordered by the court and some serious issues of concern came about in the report. Among these, the psychologist was very concerned that he stopped taking the medication for his mood disorder and stopped psychotherapy. He was also concered about the fact that my husband is an alcoholic, but not attending enough meetings to maintain his sobriety, given that the test showed a strong tendency toward alcohol dependency. A third issue of concern was that my husband is very paranoyd and angry with me and the psychologist warned him about this attitude affecting his relationship with the children.

    In light of these issues revealed in the psychological report and the previous court order that he can only have contact with the children under professionally supervised visits, I am asking the court for sole legal and physical custody. My husband warned me that the court will never go for that because he attended a parenting class and his supervised visits have gone well for the most part. However, he is still not taking his medications and not seeing a psychotherapist. The children's therapist wrote a letter to the court stating that the children are still afraid of him and doing much better in my care since my husband left home.

    What are my chances of obtaining sole custody of the children. In this last year since my husband left they've had the best year of their lives, honor roll in school, certificates of excellence, strong community and church volunteering, etc.

    Sounds pretty good with him getting supervised visits of course.
    But remember he can still in years in the future still come back and ask for the visitation order to be modified
