    House guest rules eviction
I had been involved with the person that lives in my home for 5 years, but for the last 2 1/2 years we lived in the apartment as friend only. He worked on and off through the years and never kept a steady job! For the last year he has been living in my home paying nothing at all. I asked him 9 months ago to leave and he will not. He got up in my face one night and threatened me, I should have called the cops then. I then filed at Rent Court but the case was kicked out because he never paid rent. He would pay bills a some periods . I felt foolish but I did not know at that time where to file. I have now filed the Unlawful Detainer, and I have to wait for the process. He has the only key to my mailbox. I do not speak to him anymore and I know they will be sending the court date soon. I'm not sure how to approach him about the key, but he might screw me for my court date. Should I call the cops when I ask for the key? If I do , I keep thinking there not going to help. Then I'll be looking stupid again, like when I was in the Rent Court. I really want this person out my house before some one gets hurt! I want to change my locks but I don't want to break laws. I'm a prisoner to my bedroom and I'm paying all the bills.

It looks like you're stuck with him until the Court date unless you get an Order of Protection - do you have PROOF that he's a threat to your safety.

Concerning your mail - go to the Post Office and have them hold your mail, tell them you will pick it up.

No, you can't change the locks - but you already know that.

But rent court is where you needed to be, most likely part of the issue is your terms, he is not a "house quest" but a resident who is not paying rent. If he is not on the deed, and if he is not on the lease or rental agreement, and he is living there, he can be evicted. If handled properly.

I would say get an attorney since you have stumbled on this already

During the argument a few weeks ,he got a knife and cut a hole in the mattress but other than and few pushes and shoves there were no bruises or anything on me. Thanks for the post office information. I'm just so angry at myself about this whole mess! I let things linger too long! I know it will be over soon. What bothers me is the fact that the lawmakers are making me spend money to get rid of a bum that's living off me. What a rip off!

He has never been on my lease. The Judge dismissed my case because I never had an agreement with this person for a specific rent amount. The person also showed up for court and once the Judge found out through him that we were once involved I was shut down. That's when I found out about the proper to file papers with. If I could afford a lawyer I 'd be on it like Johnny on the spot . These are life's lessons that have no room for a repeat performance Thanks for your advice!

You have allowed him to become a legal resident. He must be evicted but I think you are foolish to have not called the police already. He is an unwelcome guest who threatens you, pushes you and damages property. The eviction process can easly take 30 days which he can use to make you suffer worse. Stop writing here and start calling the police, press charges, at least you will know where he is sleep that nigh. Good advice from other, follow it
