    Can we legally evict my mom?
    My mom sold her house and used that money to make apartment from our garage. We agreed she would pay $200 while living inside the house until it was done we also said if we ever sold our home we would give her something for the money she put into it.
    She moved into it and we presented her with a lease and conditions and all that along with what we wanted monthly. She has avoided us for days now and she finally texted me saying she did not agree and that she would ONLY pay third of utilities and that was it. That alone does not cover the increase of all the bills and expeses of the house since her moving in. My family is having to sacrifice things just to make sure all bills and expenses are paid. She is being disrespectful of our space and home and belongings but still expects us to "leave her alone" and stay out of her space. Can we legally evic her?

    Sure. She doesn't have a lease, so she's a tenant-at-will. You no longer desire her to remain, so give her the appropriate notice and when that notice period has passed, you can go to court for an order evicting her.

    She might counter-sue you for the expenses of fixing up the garage, but that's another issue.

    You will need to pay her back any money she spent on the garage, but yes you can evict

    She spent it knowing that the only way she would get any of it back is if we ever decide to sell the house. She had agreed to that and that has never been discussed again. She is un willing to sit down and compromise with us.

    She is down right refusing to sign the lease which is very much in her favor except the monthly amount to cover her expenses.

    I completely agree with AK lawyer. There's a sticky at the top of the 'Real Estate Law' page that has a link to each state's ll/tenant laws. That should tell you how long of a notice you have to give her before you can go file for the eviction.
