    Landlord is trying to weasle me out of an extra months rent
    Hey I need this answered ASAP. I move out tomorrow.

    I have been living month to month with a lady for the last four years. I told her in late March that I was going to be leaving in June. But that I wold pay the entire month of June so she would have time to show people the apartment. I did this out of courtesy to her because the apartment was a mess after four years.

    I have paid for this month, and she has my security deposit of 600. On Thursday she tired to show the room to someone but on Wednesday she told me that she wouldn't.. well I was not prepared, and she culdn't open the door because there where boxes there. The room is a mess full of boxes and garbage bags (because neighbors complained that there where too many garbage bags and they couldn't throw their trash away, I have had to keep the garbage bags in the room)

    So I am leaving tomorrow (saturday) and yesteerday she took a picture of my room and then told me I have to pay for half of July because the room was not in condition to be showed to people... even though she has my deposit, she has my rent for the full month (ad I am only staying there till tomorrow.. 9 days out of 30) AND I have it in writing that she said OK that's fine, to my suggestion that I pay for June but leave early so she could show people my empty room... so that during finals in May... I wouldn't have to start packing and cleaning till after finals where over.

    We have no written agreement... and it has just been month to month. Who is in the wrong here??

    If she keeps your deposit and you think she's in the wrong, just take her to small claims court. And KEEP YOUR COOL there if you do. My last landlord was a scumbag who threatened me when I gave my 30 days cause he was losing 2 other tenants, hit me with a 680$ bill for staying 3 days out of the month. I took it to small claims, showed pictures of the apartment I took when I moved out, and said I gave notice and he didn't except it and threatened me. I got it turned over, got my deposit back WITH interest. I can't say the same will happen with you, but small claims court is really the only thing you can do to settle a dispute like that. That's the advice a renters rights legal number gave me at least.

    I do have to say that the landlord does have some ground here. If I was shown an apartment with garbage being stored in one room, I sure wouldn't be renting it! Plus I would be prepared for some pretty high cleaning bills if I were the person moving out.

    As long as the place is clean and tidy when you actually move out (in fact by the end of the time you have paid for!) she should not be able to keep your money. No one can expect a place to be immaculate when you are in the process of moving out. You gave your notice (and plenty of it!) and she is trying to keep your money because she left it until the last minute to try to find a new tenant, and didn't manage. Her problem not yours. I had a similar landlord back in my student days, tried to keep my deposit for unpaid utilities, so I threatened him with small claims court and got a cheque a few days later. They all try it on, don't let them.
