    I just found out that my husband was and maybe still is having an affair. The problem with this is that the women is a close friend of my younger sister. And get this she is also married. She has been to my house, I have watched her child for her, and I have given this women funiture. I found out through my husband's sister. He admtted to her that he was messing with this person. We have two children together and lived in a nice home, and I don't want my children to suffer on account of my husband and his married mistress.

    Now my question is this, does anyone know if I can sue this women for emotional distress? I have heard of a women suing her husband's mistress and won her case. Please if anyone has answers let me know.

    Suing her will only drive him closer into her arms.

    Instead, ask him to go with you to marriage counseling. If he won't go, then go alone. There are many counselors who have a sliding scale (if you need financial help to be there), but if there's money available, your husband owes you at least a good counselor. Then you will be able to talk through what has happened and put together a plan.

    How do you know it is true? Are you 100 percent sure it is true. Or could it be someone just trying to mess things up? Did you confront your husband about it? Did he confess, or did he deny?
    No, I do not believe you can sue this women for emotional distress, If it is happening or did happen. The responsibility rests with your husband. Marriage counseling is important. I would suggest that this would be an option before even considering the last resort which would be divorce.

    I have seen it done in one of the law offices I worked at many years ago, but only DURING divorce proceedings, however I don't know the final outcome as I moved before it was over.

    Personally, I'm a confrontational person and I would confront this other woman and if she admits to it, I'd tell her husband. I would also say to confront your husband if you haven't done so yet because it might be possible that your sister in law is trying to start problems. I don't know how close you two are or if you two are friends but I would take it with a grain of salt until you find out if it is indeed true.

    If in the event it is true, would you be willing to forgive your husband? If so, it may be time to seek out marriage counseling. If infidelity is not something you can forgive then it may be time for a separation or divorce.

    I do not know anything about sueing a mistress, but I know you can sue for mental anguish, so I don't see why not for emotional distress. However, that is something you should contact a lawyer about. If you look around, there are lawyers you can get free legal advice from.
