My 18 year old sons new baby
I live in NC and I have a 18 yr old son who is a college student. He was dating a wonderful girl and she got pregnant. They told me right before Thanksgiving and although shocked we accepted it and wanted to do all we could for both of them. Before Christmas his girlfriend broke up with him and said he did not need to know anything about the child until it was born, which she did not want him coming home and going to any of her doctor appts with her. The baby was born this month and she will not let him see the baby. Does my son have any rights at all. I am sure his name is not on the birth certificate. This situation is breaking my heart. This child needs to know his other family. My son is a great guy. Please help anyone!!

Of course you son will have rights as soon as he files for them and gets them awarded by family court.

He should have as soon as the baby was born, filed for either joint custody or at least visitation. He may have to prove he is the father by DNA tests ordered by the court. And the court will set the required child support he will have to pay.

Yes your son has the right to see his child. Although a lot of people don't know this that a father can also put the mother on child support and try to get custody. He needs to go talk to a child support office and he is going to have to take a dna test to prove his paternity because his name is not on the paternity papers.

He needs to acknowledge paternity. You are a good mom to want to help him, I would hire him an attorney right away so he can assert his rights as soon as possible.

Here is a form you can buy online to file as well. North Carolina Affirmation and Acknowledgment of Paternity
