Hopefully, I am doing this right. I posted a question before concerning custody modification. Anyway, my kids bio-mom Is requesting the judge change the weekend visitation to opposite weekends because she got a new job where she works the weekend she is to have the kids. We tried to find a way to change our schedule or acquire childcare to do so for her but could not do it. We filed first because as it was the schedule we have been following now for two years was a verbal agreement between my husband and her. That we changed for her due to her job at the time.She refused to come get the kids on scheduled weekends because according to court order it was not her weekend.the judge has temp. changed it for her to what it used to be. If changed for good it will affect our jobs because we work that weekend she was having the kids. Do we have a good chance of keeping it the weekend it's been or will they change due to the fact she now works that weekend and won't see the children as much. Now she took this job knowing the situation with vistitaion, and without talking to us about changing it . I don't know should we start looking for new jobs to satisfy her request or will the court side on keeping things stable in the children's home? Sorry so long.

Well unfortunately I am pretty sure that will really be up to the judge. A judge may very well "side" with her on this because she is the absent parent and therefor she as less time and that is not what a judge is likely to see as best for the children, continuing for it to be difficult for the children to spend time with mom that is. See the judge isn't going to really decide based on what is best for any of you and your jobs but what will allow each parent to work and for the CHILDREN to have access as much as possible to each parent. It really will be up to what the judge decides is best though because there isn't any specific law regarding that particular issue.

Who has custody?

Their father, my husband has custody. The mother has a bad job history only keeping jobs for 6 to 10 months. So in another 6 months or so we could have to do this again.

Well I wouldn't be looking for a new job too accommodate BM! If you have proof of her job history, you should show that to the judge to show the instability.

It depends on the judge but if BM knew what she was doing, then the judge should keep things the way they were. It's her fault that she screwed things up. Why should you have to sacrifice your weekends with the kids?

Because your husband is the CP and spends the week with the children, it is very likey that the schedule will be changed. After all, mom is trying to better herself by getting a job. I understand that she is not "job responsible", however she is the mother and does deserve time with her children.
