My 18 yr old daughter who still lives at home was taken to a doctor by two other family members without our knowledge. My daughter did not have a copy of the insurance card but someone somehow got the info because a claim has been filed for the visit. After the family members that took my daughter informed us we were very upset, they even then called the police and stated my daughter was in serious need of medical attention and was being held against her will, which she wasn't. When I called the doctors office and explained I was upset that she was seen without our knowledge and wanted to know what was wrong with her they told me because of her age they couldn't tell me anything, but within the hour of calling the doctors office called my sister in law (who took my daughter) got a call from the doctors office and informed her that my daughter was a "very very sick little girl"... but the doctors office did not bother to call my daughter... just so you know my sister in law has two friends who work in this office. Has there been a violation?

I doubt it , This sounds just like bickering. This also could be construed as heresay. For instance if they faxed or released test or information pertaining to your daughter's visit this one or prior visits to this person or any person concerning her medical care or insurance. They must have a release form signed by your daughter in order to give this info out to anyone, even you.

My daughter was unaware that she was going to the doctors office, they came and got her and took her, told her they were taking her out to lunch. She said she didn't fill out any paper work that it all had been filled out before she got there.

She could have refused treatment. I don't think the dr. would have examined her if she had. If they signed release forms for that dr. office to release her medical info to them then all parties involved can be in trouble... call hippa they will gladly investigate, in the meantime request all medical records from her dr. I would go in person and stand there while they make the copies that she wants... you may have to pay for them.

Unless your daughter contests any of this, then you can make a big deal out of it. You can't request medical records from her doctor unless she signs a release because she's a legal adult. You're making a mountain out of a mole hill. Is your daughter well now? Then let it go. Don't be so upset that you weren't included. Please don't take this as me being a smart aleck it just sounds like you're looking to get everyone who was concerned with your daughter's well-being in trouble.

Maybe I'm missing something here, but where is your concern for your daughter? If the doctor's office said she was very sick wouldn't you be happy someone cared enough to take her to see the doctor? Did your daughter tell you what the doctor said?

Just having someone in the doctor's office say she was sick is probably not a HIPAA violation. If they said what she was sick from that would be. You also have no proof that the doctor's office said anything, just your sis-in-law's word. And, if she was truly very sick then why did the doctor's office not call her?

This is one of those situations where we are only hearing one side of the story and that side is full of holes. Maybe if we knew the whole story we could advise better.

I agree that the sister in law is probably making things up here. But my questions is does your daughter have a continuing illness such as diabetes, lupus, epilipsy, or something like that? What would cause them to just swing over, lie to her and then take her to see a doctor? ScottGem is correct here, we need way more info, your leaving way too much information out.
