How does Tennessee annotated code 39-13-306 apply when the father has custody?
39-13-306. Is for custodial interference. I do not think that there is a different status for custodial parents-both mother and father.
If the non custodial parent will not turn the child back over to the parent with custody. So if the father has legal custody, and the mother will not give the child back when she is suppose to, they are interfering with custody.
Yes-it does not matter who has legal custody.Quote:
