    I think he can keep it legally because that is what you give it for, your word you are moving in, partially.

    He held the space for you, therefore no one else moved in. he lost more money than you security

    Hello v:

    It depends. Did you sign a lease? Did you give him ample notice? Did you get a receipt? What was the deposit for? Security?

    If you really want to know if he can keep your deposit, sue him in small claims court and the judge will tell you. It'll only cost you about $50 to do it.
