    Florida Foreclosure Guidelines
    I live in Florida, under Florida law how late does someone have to be on their mortgage payments before said mortgage company can legally begin foreclosure?

    I am right now 28 days late on my mortgage, so should I be worried about a possible foreclosure?

    I have heard that you only have to be one day late in order for a mortgage company to begin foreclosure, friends have told me that you have to be at least 3 months late before they can do anything. So which info is correct? Is there any set guidelines which a mortgage company must follow before they can begin any type of proceedings to take my house?

    First, you shouldn't put your personal e-mail in a note. I would sugeest editing that out.

    Second, how soon they can foreclose is written into your loan documents. In some cases, they could start proceedings as soon as you are late. But the process could take several months. Normally a lender won't be so precipitous. They really don't want to foreclose. They gain very little by doing so.

    If you haven't been chronically late, they are unlikely to take action until you are several months late. But you NEED to be upfront with them. Let them know what the problem is and try to work something out with them. If they have to come after you, they will be less forgiving.
