Why are you trying to evict? Is there a lease in effect? What technicality did the judge cite? What else have you tried?
Non payment of rent, noise, trash, 7 people in apt lease only allows 4 I pay part of utilities
Frankly, I don't understand then why you are having so much trouble. I notice though, that you don't mention the technicality. But if they aren't paying the lease, then it shouldn't be so hard to obtain an eviction. There may be a landlord's association in youyr area that can help with the process.
I have a suspecion though, if these people have enoungh money to pay a lawyer but not their rent, I suspect there is more to this then you are telling us.
Your loss of rent is probably costing you more than a lawyer. Grandpa used to say if you're in a wee wee match with a skunk you better get your own skunk.
They have a legal aide lawyer its not costing them a thing. In KY you can get a jury trail for an eviction. She plays sick to jury and court, "says she has cancer and she can't afford to pay rent.
That's BS. The law doesn't recognize that. You, as a landlord are not a charity. The law states if you don't pay your rent without good reason (and good reason is some deficiency in the rental premises, not your ability to pay), then out you go. EVen if a jury sympathized, they can't rule against the law. If they do the judge has to throw it out. But Ballenger makes a good point, the lost rent is probably costing you more than a lawyer would.
Looks like I'm going to have to & raise rent to start legal fee savings. That I don't think is fair to other tenants that are paying. Do you know a BIG skunk in KY?
My uncle was a big skunk in E town but I think he's too old to smell now.
