Parents not wanting to support or take care of child
My ex boyfriend, the father of my three year old, does not support my child or want to watch him at anytime for me even when my son asks him too. He still lives with his mom and his mom takes care of him when he is over there, not his father, he does other things instead. My son says he mostly sits on his bed and watches TV. My fiancé wants to adopt him and I don't think his father should have any rights to the child because he pays no attention nor does he do anything to help me with him, my fiancé does. Is there any way I can go about removing his leagal rights to be his Father? He does not deserve such a wonderful child. And my son does not deserve the neglect. Can I put in a petition for him to sign over rights even if he doesn't want to?

First of all, you'll want to contact an attorney. I do know that if his name is on your sons' birth cert, he will have to sign over his rights, Legally. If not, than technically he doesn't have any say. When my daughter was born 9 years ago, I was 19 and scared. Her father lives about 300 miles away. He didn't and still hasn't really been a part of her life. His name was nowhere on the birth certificate. But when we started going to court for him to pay child support, they asked for a paternity test. Of course, she was 99.99% his. When I was married, my husband was wanting to adopt her and even though his name is not on that cert, he STILL had to sign his rights over according to my attorney. He owes me almost $30,000 in child support and still out running the streets! Good Luck!
