Before our divorce, my ex husband gave my son (not his bio. Son) a truck for his 18th birthday. The titled was signed by both of them and dated. We didn't transfer the title over immediatelt because my son couldn't afford the insurance. Nonetheless, the title was signed over to him.
A year later we split up and eventually divorced and the truck had been kept in storage, paid by me, to be rebuilt but we still had not transferred the title. My husband offered to buy the truck from my son for $600 so that he could rebuild it and give it to our youngest son. Everyone agreed and we let him take physical custody of the truck.
The problem: My ex then took the title, which was signed by he and my son and was somehow able to sell the truck without my son ever signing anything or agreeing to anything and of course he never got paid either.
How is it possible to sell a truck that was signed over to someone else? WE thought we were going to have to go to a tag and title place to revert it back to my ex.
How was it possible for him to steal this truck and a title company not question a signature on it that didnt; belong to the person who bought the truck or sold the truck?

He could have asked the state for a replacement title by saying it was lost, destroyed. The state will ck to see if he's the registered owner and from your prior stmts, it appears the title was not transferred out of his name and as far as the ownership of the veh, it is still techically your ex spouse's vehicle and he can do whatever he wants with it. Though his actions are perhaps not morally correct, it's probably all perfectly legal since the ownership was never transferred.

He used the original title that was signed over to my son, is it possible that an agency would accept a title with white out on it?

I can't say what a state agency might or might not accept, they might accept anything for that matter, but let me say most states will not accept original titles that obviously have been altered in any manner. He oculd have simply stated in a affadavit or other written format to the state that it was lost, destroyed etc.

WEll either way, even if he could, my son wouldn't pursue any legal action, the man helped raise him then stole from him, and he just says that if he wants to be a scumbag let him.
I just hate feeling helpless and pissed off that I couldn't protect my son from getting hurt and wish there was something I could do, but you stated the obvious and I there's nothing to be done.
