Can a US citizen have a Spanish passport without having to give up his American citizenship? My husband is American and I am Spanish and I don't know if there is any kind of agreement between the US and Spain in this regard.

You only lose citizenship if you denounce it, so yes, you can hold both passports and go back and forth and not lose american citizenship. Any local consulate or passport office can confirm this. You may lose it if you move to spain and never return after several years though, but in general you are allowed to be dual with any country the US will trade with

So my husband being American could lose his American passport if he doesn't come back to the US in a few years?. I didn't know that...

Well the passport will expire, I was meaning more that if he never returns yes he may lose it. Also if he becomes naturalized in Spain he can lose it also.

The answer to your question is that your husband will never lose his US citizenship, unless he voluntarily renounces it.
