    Roommate won't leave. Never paid rent. I own the condo.
    I own two properties and one is being rented out to someone who has never paid me rent. She did me a favor because she is a Real Estate Agent and saved me $2,000. She needed a place to stay, so we worked it out (verbally, no lease singed) that I would not charge her for 4 months rent. Since the 4 months has been up, she has not paid me a dime in rent. She owes me a bit over $3,000 in back rent, not to mention her half of the utilities , which she has rung up.

    I live at this property in Minnesota 2 weeks out of the month and at my other place the other 2 weeks. She's been lying to me about paying me for months now, and I kept believing her. She works a part time job and spends all of her money on food and on alcohol. I want her out, but I don't know what my right are. She told me she was moving out today (May 12, 2007) and I showed up today to find out she is not moving out and she will not tell me when she is. I have e-mails from her saying she would be moved out this weekend. I have one witness who rents from me at my other property who spent a holiday with her, and she told him that she has not paid him any rent whatsoever and she knows she needs to find a job to pay the rent. Could I use him if I have to take her to court?

    I need her out by the end of the month because I have a new person moving in, and yes I did draw up a lease with this tenant. Lesson learned. This new tenant has a job (40 hours a week) and he's set to move in. How do I get her out?

    Also. When she moved in with me, I had no furnishings at all. She had moved from a house she lived in alone (now I'm thinking she was evicted from that place) and she furnished the place with her things. The condo looks great, but they are her things, not mine. We had no agreement about a rent reduction because she furnished the place instead of putting her things in storage. I realize now I should have gotten references from her, but she's been a very good friend up until now. She's not kind to me and has been very rude and short with me.

    Well if you have not started eviction proceedings you are not getting her out by the end of the month now, Have you ever served her with official noice.

    So serve her with official notice to move out and if she does not move then you file with the court to evict.

    No I have not given her any papers saying she needs to be out. Everything has been verbal and she even said I need to find a replacement for her because she hasn't paid any rent. That was back in march. I gave her more time thinking she would find a real job or sell a home. She was my good friend. Lesson learned.

    I told her I have a person who is going to rent from me and is moving in on the 27th of May. She says she won't leave till she finds a place to live, but she has NO money whatsoever. She's been lying to me about a lot of things lately.

    How do I find out my rights? She did not sign a lease because we discussed her living with me because her old landlord was selling the house and she needed a place to stay. I'm realizing now the landlord probably evicted her. At least he had the brains to have her sign a lease.

    It's a 2 bdrm condo. She doesn't even want me in the condo and I am the owner. She has no right to tell me not to spend the night in my own place.

    Hello, I do not have an answer but I am going through the same thing. Almost exactly but this person was a stranger. I too gave her until the end of the month, and hopefully I can remove her belongings w/o it being a mess. Good Luck to us both!!

    You can't "give her til the end of the month" and think that will work. You must evict her and the sooner you start the sooner you'll be rid of her. She is a month to month tenant even without a written lease.
