You need to get an attorney to file a petition to formalize custody and child support arrangements with the courts... basically to sue him. Then, his child support payments will be court ordered and subject to legal enforcement.

You need to sue for divorce, get court custody ordered for the children and get a court ordered child support, you can then get help with the support after it is court ordered.

You need to keep takinghim back to court for non payment, and work with your state child support enforcement people

It's easy to say get an attorney... most people realize that is the best option. If your in a financially precarious position you may need help as your main source of income has left. I would try any legal aid cntr that would help with the divorce and child support enforcement. These processes can be slow so, of course, it would be best if you could somehow get an attorney. You might try calling social services agencies or the local law school to see if they offer free/reduced programs. The most quick way is to file for divorce with an emergency custody/support order. They will look at both your's and his income to determine the amount he should pay. I'm sorry to see you going through such a hard time. Hang in there. Cathy

To get straight to the point, you file for divorce. The divorce agreement will include an agreement on child support.

Since this appears a clear case of abandonment, he will most likely have to pay for your atty.
