    If you received ttd payments and then later found out that your employer did not use the correct wage statement, meaning they did not use gross wages but net wages instead. This causing a lower ttd payment than what should have been, will they have to reimburse you for this underpayment?

    Who do you mean? The state or the employer?

    I would assume it would be the workers comp insurance company as they were the one's who was paying me. Either way employer or state is it not a law that they have to do that? As it clearly states on the wage statement form for the employer to fill out to use gross wages, all bonuses overtime etc.. And they used the net calculations. It states it is a crime to provide false info and that's what has been done and in the meantime I got cheated out of money.

    Have you asked your employer to resubmit the paperwork with the correct information? Perhaps they misunderstood the paperwork.

    All checkstubs with correct info has been submitted to workers comp. We found this out at a mediation meeting. This was done about a month ago and have not heard a word from anyone.

    Why not consult an attorney? Many do workman's comp on contingency and don't charge you for an initial consultation. I guess it will boil down to how much you received versus how much you shuold have received if the paperwork was submitted correctly.

    Thank you for your response.
    I do have an attorney and it was the attorney and I who found the error. I just thought I might find if there was a law about this or what they would have to do about it.
    Anyway appreciate it.
