    What is going to happen?
    I filed a restraining order on my husband and took out an assault charge 10 days ago. Our court date is tomorrow. We have a house together that I am currently living in with our 2 kids. My lawyer just called and told me that his lawyer was going to have the restraining order case continued tomorrow so we would not be going to court. Here's the thing: My husband has filed a child custody action and an equitable distribution act against me. He is agreeing to pay the mortagae for now (in place of child support). His income is twice what mine is. I do not have money to hire a lawyer for these other issues. Can he make me sale the house, take the house, take the kids??
    He is very manipulative and he always told me he would screw me if we ever split up. I got an apartment for a few months last year and then I came back.
    How do I protect myself, my kids, and our house?

    Your atty should be handling everything.

    Whether he can take the kids depends on whether he can show they are better off with him than you. And that is a hard thing for the father to do.

    Whether he can make you sell the house depends on the divorce agreement. Your atty should negotiate that on your behalf.

    Be calm you know he is not going to get custody. (he is abusive) And besides its just not going to happen. And furthermore distribution can only (I think) be made after the divorce is final, and in NC that is at least a year.
