My husband is ill.
We don't have many properties or money, all we have is our home, it is not a mansion, but it is worth a significant amount of money.
My husband's son and his ex-wife are the most money hungry, self centered people I ever met (and I am not exagerating) they have tried several times along the years to come up with ways of getting money from us.
We have worked hard to get this house, me and him! After he divorced her, he had nothing, all we have came from the hard work of the 2 of us!
No that he is sick, no one helps bying not even an aspirin.
Anyhow, I am afraid that if my husband passes away, the two of them will come after me with all they got, I am even afraid to end up on the street, If they find a way they would do it they, would take everything.
My husband has a life insurance, 75% on me and 25% on his son, but I know they will not be satisfield with only that.
My question is, can they take my house? And if they can, what can I do to protect myself?

Does your husband have a will? If not get one now. Since he is divorce, she in not entitled to anything from him.

No. My husband does not have a will. I asked him for one, but he does not do it, I don't know if he does not want to think about death or he does not want to desapoint his son.
The house is in my name and my husband's, we are legally married, can the son claim anything if my husband dies and does not leave a will? Shouldn't the house goes to me?
Also the fact that I am not an american citizen affects anything as far as my rights?

They cannot take your house as you are the legal owner. You're not a citizen but are you a legal resident?

There are several ways in which married people can deed their property. YOU need to find out exactly how your deed is worded. Some deeds may allow the children to make a claim. In my state, in order for someone like you to be protected, the deed needs to have the words "WITH RIGHTS OF SURVIVORSHIP". The intent of a deed like that is clear.

I understand, and don't understand at the same time, your husband's reluctance to face his own mortality. Ok, he's going to do, what he's going to do. YOU, however, should seek the services of a real estate attorney. He can at the very least, explain exactly what awaits you. Hire one NOW. You don't want to be surprised.
