Summon from Collection Agency on Old Credit Card Debt
I received a copy of a Summons and Complaint in my mail box. It was mailed by first class mail. This Summon is from Asset Acceptance, a debt collector agency. They have bought over my Providian credit card account which has been charged off (with last activity in April 2001 - based on my latest credit report). According the Asset Acceptance, the date of deliquency is 5/14/2001 with a balance owe of $1462.75
I know that I should file an Intend to Defend with the court, based on my reading from the other posts. Is there any sample letter of the Intend to Defend notice that I can reference to write my letter? What do I need to mention in the letter besides my intention to defend on this case? I am located in Michigan and the SOL is 6 years for credit card debt. So, they just file the Summon at the very last minute. Can I used the SOL expired in my defend if I am asked to show up in court?
