    Security Deposit.
    I moved from Virginia to main On January 30. Virginia state laws says that the landlors must return a deposit by 45 days. My lease states 30 though. Now it had been 93 days. But anyway My landlord keeps telling me that he sent out the check 4 or 5 weeks ago he told me he sent it out and to wait to see if it came in the mail so I did, it never came for 3 weeks so I called everyday. Now he is saying that he reissued the check like over a week ago. I do not believe that he sent the check. Can anyone tell me what I need to do as far as how to get things together to go to small claims court?? Please help I need the money soon to fix my car.

    Sometimes landlords are very reluctant to relinquish that security deposit and will find many excuses not to. "The cheque is in the mail" is a real deal breaker for me and I don't stand for even twice, then I act. You had better act soon. Although I don't rent anymore and when I did it was a really expensive house, so the security would be 2500 at least.

    Small claims court is your best option but just get all your ducks in a row and take pictures of your domicile (no damage to walls or rugs or anything else) and go for it. Here in Ontario, small claims tend to favour the rentor.

    Yes small claims court, if he really was going to pay, he would have.
