    Good Dad
    I want to see my son and pay child support!
    My son mother moved to Las Vegas when he was 3 years old at this time me and her was together living in the same house and every thing . She went down to the walfare office and told them she did not know were I was but at the time I was right there with her and my son. Now 13 years later since we both moved on and I had another baby and she did to she wants to file child support on me. She does not let me see my son AT ALL I don't have a problem with taking care of my son but I want to see he as while but since she doesn't stay out in Los Angeles she don't want him to see me .What should I do since I have to pay child support and I want to send time with my son?

    The two rights (1. your right to see your child 2. her right to file for child support) are two distinct and separate rights. She cannot deny you the right to see your child just because you don't pay child support. You can't refuse to pay child support because she won't let you see your child.. tell her that preferably in writing (and send it to her and certified mail where she must sign as receiving your letter or where an the PO shows they attempted to deliver, give her time to respond an dif she doesn't, then take your letter, info to an attorney and ask him to handle it for you.

    Or go down to Child Services and say "I pay child support and she won't let me see him" Well who has custody of the child? Does she have full or what? Do you have legal rights to him? I know in VA if the parent pays child support they have the right to the child to see them! You could poss get him for the whole summer if you guys live far apart!

    I have a good friend whose ex was not letting him see his son, he filed several motions with the court where the custody agreement was filed, and got set days he is allowed to see the child, if she refused it, she has to pay a penalty to the court. So basically you get an attorney and force her to allow you to see the child.

    I am from Los Angeles CA and from my experience the court will decide whether you have earned the right for visitation rights or not--- even if you are paying child support. This can only be over ride by the custodial parent if he/she would permit the child to have some relation with the non-custodial parent(if the court finds no visitation is allowed)---or he/she agrees with the court's decision that no visitation is allowed for the sake of the child.
