    Hello I have Primary-Physical custody of my oldest son. His birth father had partial custody. I have not seen nor heard from the birth fater since my son was 3 he is now 13. I am married and my son does not know that my husband is not his birth father. But to me he is is father in everyway that matters. My husband would like to adopt my son. But we have no idea where the birth father "sperm donor" is can we have his rights TERMINATED? For no contact?? I live in PA. There is no father listed on the birth certificate. In PA a Paternity Paper has to be signed in the hospital and notorized if a mother is un-wed this was never done. We went to court for custody though years ago

    A good attorney will probably file a notice in the newspaper for several weeks. Once no respnse is received, they courts usually will allow for abandonment and revoke the parental rights which allow your current husband to adopt.

    If you really don't know where he is, there is a procedure as noted above, like posting in a legal section of a newspaper, and they may have other requriements as to trying to find them. But if they can't be located it is possible to still do it.
