Filing separately, as if you are divorced, does not automatically divorce you. If you have not filed formal paperwork with the courts and received a judge's decree finalizing a divorce, you are NOT divorced.
From your other post, you are divorced, you had a legal divorce, you were not married since your divorce and your state does not allow for common law marriage
So you are divorced, just lving together , shacking up, playing house, or living in sin.
Thanks for clearing that up Fr Chuck. I did not realize poster was continuing a question from another thread. I just went back to the original divorce post.
Asia, I agree completely with Fr Chuck. You filed for divorce. It doesn't matter if you never actually split up and have been together for 28 years. New York has not recognized common law marriages for many, many years. NY State and the U.S. Government consider you divorced.
