    Probation Violation
    I was convicted of a dwi last spring and was put on a year long probation. I recently was ticketed for 3rd degree aggravated driving without a license and received a marijuana possession ticket at the same time. I cleared my license up almost immediately because I hadn't even known it wasn't in order. I went in to see my probation officer today to tell her what has happened to me and she had me do a drug test. I tested positive for thc. She's sending the information to the judge. My dwi fines were paid, classes attended and had one month of probation left when this happened. What should I expect to happen? I really want to avoid any jail time. I'd much rather check myself into rehab or have my probation extended. I'm just not sure what to do honestly.

    It all depends on the Judge, but the worst that could happen is a few weekends, at the county farm. Nothing too bad. But I dought they will extend probation. But you may get another, probation for the pot. And more community service (I hate it). Don't sweat it you can't change it now, just learn from it and leave all that stuff alone. (I been there) Heck, I (am there) have to go to court next week.

    I'd much rather do community service than spend time locked up. Locking me up isn't going to do any one any good. I'm hoping they just put me on probation and urine test me. I'm not worried about slipping up. If they had been testing me from the start I wouldn't ever have done it. Would it help if I checked myself into rehab? Is it even worth my money to get a lawyer for this or is it pretty cut and dry. The facts aren't in question.

    I once went to court without a lawyer (the cop told me he would get the charges dropped, but then didn't come to court) and have been paying for it every since. It's pot they are not going to care about rehab (but ask lawyer anyway.) The thing is with a lawyer you have allot better chance to be treated somewhat fairly, and not be subject to the Judges bad mood.

    You are not the only one it happens to lotts of people all the time. And even if you go to jail (it's not fun) you will make it through. Look at all the people who have. I don't think you will, but if you do it's not the end of the world.

    You should hire a attorney today!!

    Since the PO is sending this to the judge that means he is sending to revoke your probation, which means most likely the rest of your probation in jail, or a much tighter probation,

    Using illegal drugs on probation is not taken lightly by a lot of judges.

    Hello Once:

    I think you're going to the slam for a few months. I don't think asking for community service or rehab or extending your probation will do squat.

    A good lawyer might keep you out. I don't know. Judges really don't like people to drive after they've taken their license away and given them a chance. And, they really really don't like it when the charge was substance abuse related and you get busted for using another substance.

    I don't wish it on you, but I'd carry my toothbrush in my pocket.
