I don't want him in my child's life anymore
My soon to be ex estranged husband for 7 years has never been there physically finacialy, or emotionly for my 7 year old son. I'm filing for divorce trying to do it on my own but I've come to a glitch. He says he don't want nothing to do with our son he wants to start over. So he heard from a friend he could just sign his rights away and he won't have to pay child support I seen another question like this but no real answers. I live in Texas I have tried to get this man to see his son at least 20 times he refuses. So I don't want his help anymore I don't want him around he don't want to be around I have a boyfriend of 5 years who wants to adopt my son but he has a criminal record. So my question is can my soon to be ex sign his parental rights over to my boyfriend with whom I have 3 kids with already. Would his criminal record keep him from adopting my son ?

My son don't even call the ex daddy he calls my boyfriend daddy.

He? I'm assuming you mean my boyfriend?
He wants to adopt my son so he can take full on parental rights he has the tittle of daddy he just want the rights of daddy. He would also like to change my sons last name to match every one else's after I get divorced me and my boyfriend will be marring and I don't want my son to feel left out. He(my son) has already asked when you get married to daddy will I get the same last name as you mommy? Me and him have the same last name now which is my ex's name so you see my delema can some one answer my question. Please?

I would check into adoption laws for your state. If your ex is willing to give up rights and your boyfriend is wanting to adopt - it sounds like a win/win situation for your son.
When you say criminal record - is it a violent crime - a crime against a child?

No it was drug related and from 1999 before I even met him.

Thank you for answering my question.

If he can't adopt - could you change your son's last name? My friend is going through that with her daughter and her daughter wants the same last name too. That isn't a possibility for her - but you might have that option - if nothing else.
