Hi, My ex and I I have a 7 year old daughter. Been the responsible parent and been there for her since the day she was born. My ex is married and his wife is such drama and a troublemaker. Won't stay out of our business. Always texting and emailing me with complete nonsense regarding the care and safety of my daughter. My ex, her father tried to take me to court in March of 2013 to try to get custody of our daughter. We went to the DRCB which we were interviewed, well it came back in my favor for our daughter to still live at home with me and I continue to raise and care for her, like always. My ex didn't like the outcome of that so that's why he took me to court to try to get custody. I presented all my evidence, etc. The judge ruled in my favor, I am now the sole primary physical custodial legal parent of our daughter. For some reason he is trying to take me back to court to modify custody and lower child support. I take very good care of our daughter a long with her older brother. He knows this, he's just trying to ruin my life.I just recently found out that he's trying to get on disability(only God knows why) and he hasn't worked in a while. He hasn't paid any kind of support in a while. I recently got married and due with a baby boy in a few weeks. My question is- is there a chance that he could get custody? That would ruin my life. Thank you.

If your just asking if there can be a custody change then the answer is yes. There can be a change. The real question is why you and him cant get along for the sake of the child? If you are agressive toward him as far as visitation goes then you may appear hostile. In a case like that custody can change.

What type of custody / visitation is he seeking ?

My ex-wife took me back to court every 18 to 24 months for 16 years, for various modifications, support issues another things. That is how life often works.
Unless there has been large changes to show the child is not being cared for, not much chance. If they are not working, a good chance at lowering child support. (of course if he gets disability, then often child is entitled to specific government payments also even if living with you)

Depending on what type of visitation he has, he can of course get that altered.

Agreed, since a court already ruled in your favor and since your circumstances seem to have improved (remarried, adding to family) and his have digressed (loss of job, disability), it seems highly unlikely that he would win a change in custody. But we can't say for sure what a court will do. It could look at the situation where you will have 2 children left and decide he deserves a chance. We can't predict what a court will do.
