    Custody for unborn
    I'm 22 and in the middle of getting my marriage annulled due to fraud on my husbands behalf. I am also 6 months pregnant. Can he fight me for custody before my child is born? I want to get sole custody, but I'm not sure if I need to wait till the baby is here.

    You can't fight for something that isn't here yet. When the baby is born you will have to file for sole custody or wait until he does. He may have lost interest in having custody of the child by the time it is born, so you won't have to file.

    The judge would want to know the reason why you want sole custody. I say put in a claim now and if they say you have to wait till the baby born you will still be on file and it wouldn't take that long cause usually they will set a date after your due date.

    First on the note of not having to file if he loses interest, you want a legal custody agreement, if not as the father, he has all rights as a father, not being married does not take away any of his rights.

    So when the child is born you will need to file for custody, he can ask for visitation if he wants it, you fight to keep it as limited as you want, the judge decides. Also you file for child support for the child,
