    Child support/custody
    I have full custody of my daughter which is stipulated in my divorce and now she went to live with her dad at 18 because she did not like my house rules can he legally take me for child support? And can the courts have me pay back order from the time she left till present? We are in NYC.

    What does your divorce settlement state about child support and when it ends? Mine stated either when graduated from high school or turned 19 years old, whichever came first.

    My child support was issued through the courts and it will be till she is 21. My divorce says that I have full custody and that he is to pay support and follow the court order. I now know that he has to first fight me for custody before getting any support from me. My question is can the courts make me pay back order from the time she left till present?

    Nice when she lives with you he has to pay. But when she lives with him it's a different story huh. Supports not so important anymore. Also he does not have to "get custody" to collect from you.
    And I can't imagine a court that would asighn "custody of a 18 year old. That an adult in America.
    And yes he can sue you for back support.

    No. I do want to pay but don't know how much? But just like I filed when she lived with me , he now has to file because she lives with him. She is still under my custody until the age of 21. And another question what if one day she gets into an argument with her father and wants to live with me again, Back to the courts we go to have everything changed... Is this supid or what?

    Sorry I didn't mean to sound sarcastic.
    Honestly you should probably talk to him about it. People will litigate in about a second. And everyone has the right to sue (they don't have to have a good reason.) Unless she is going to coll I don't see why anyone should have to pay anything. Your custody expired when she turned 18. She is an adult there for not subject to the will of her parents. There is no reason to be paying him (if you want to give her money to help out , that is diff.) But he is her father and can and should take care of things.

    She will be attending college in sept. She is going away under my financial aid, because she was living with me when she filed the papers. But yes she is going away this Sept.
