I live in Burnet County, Texas, and I have joint custody of my Great Nephew with his dad (my nephew). The child is 26 months old and has been living with me since he was a week and half (1.5 weeks) old. The dad lived at the house with us from Oct 2013 until April 2015 when I kicked him out for failing to support his son not only physically and emotionally but financially as well. The only financial support he provided was daycare and half of the cost of that was subsidized. He was told at the time I kicked him out that he was to continue to provide the daycare. In June he stopped doing that, so now I am caring for the child full time financially as well. The baby's dad has only seen him twice since June just before stopping the daycare payment, and maybe only 6 times all together since April.

The baby has not seen his biological mom (the non-custodial parent) since Sept 2014, and she to provides no support for the child.

What options do I have either getting his/her parental rights terminated or filing abandonment charges against him.

I doubt you have a chance at all for rights termination, or abandonment. But child support is doable.

Unless they are Charles Manson... the only way their parental rights will likely be terminated is if the child is adopted. At which time any FUTURE child support obligations end...

When you say non custodial parent (the mother) was that decided by a court? Also was child support ever decided?

What is the status of the father and is he an adult?
