Will a expunged record show up with a live finger print scan
What about a misdemeanor dui from 13 years ago. Will it show up if I'm applying for a job at a school district.
Perhaps. Depends upon how thorough the records search is.
You have started two threads which appear to relate to the same issue. These should be merged.
The answer is probably. The agencies which keep fingerprint data (the FBI, in the US) don't normally worry if your court record was "expunged". This is because their objective is to keep the most complete possible database on fingerprints. A court somewhere can order that its files on a defendant be expunged, but that doesn't affect the agency (which isn't usually a party to the criminal case). A court only has jurisdiction to order parties to the case to do anything.
Even the paper or digital record of the old case can float around the various states and private search companies, because they don't always apply to get (or pay to get) the new data after expungement.
You just won't know.
I think some have tried to sue over this and lost. It's a big problem.
If you do a little research you can get old charges removed from your record. It might show up, but it probably won't have any bearing on whether you get the job.
